OFFICIAL TERMS AND CONDITIONS
CROSSFIT STORIES VIDEO CONTEST – PHASE 1

NO PURCHASE NECESSARY TO ENTER. THIS IS A CONTEST OF SKILL. WINNERS ARE SELECTED BASED ON THE MERIT OF THEIR SUBMISSIONS, NOT BY CHANCE. VOID WHERE PROHIBITED OR RESTRICTED BY LAW.

IMPORTANT COUNTRY-SPECIFIC TERMS

These Official Terms and Conditions (the “Master Terms”) apply together with the country-specific terms applicable to the Entrant’s Country Contest, attached as Exhibits B through H (the “Country-Specific Terms”). By entering, each Entrant agrees to the Master Terms and the applicable Country-Specific Terms. If there is a conflict between the Master Terms and the applicable Country-Specific Terms, the Country-Specific Terms will control solely with respect to that Country Contest. Nothing in these Terms limits any right or protection that cannot be waived under applicable law.

  1. SPONSOR

The CrossFit Stories Video Contest – Phase 1 (the “Contest”) is sponsored and administered by CrossFit, LLC, located at 3623 Crossings Dr., Suite 223, Prescott, AZ 86305 (“CrossFit” or “Sponsor”). The Contest consists of seven (7) separate country-specific skill contests for eligible entrants residing in South Korea, Italy, Spain, Germany, Australia, Aotearoa New Zealand, and France (each, a “Country Contest”). Each Country Contest will be judged separately, and one winner will be selected from each country based on the quality and merit of the applicable Submission, and not through a random drawing, lottery, or other element of chance.

  1. CONTEST DESCRIPTION

In an effort to tell more stories of the lives changed within the global CrossFit community, CrossFit is inviting individuals around the world to submit a video sharing a story of how CrossFit has changed lives: physically, mentally, and/or socially (each, a “Submission”). CrossFit intends to use Submissions to build an archive of community stories that CrossFit may reshare, develop into additional content, and draw upon to identify individuals for future storytelling and creative projects, subject to the license granted in Section 8 and the applicable Country-Specific Terms.

  1. ELIGIBILITY

Subject to the applicable Country-Specific Terms, each Country Contest is open only to individuals who:

  • Are legal residents of the applicable participating country (South Korea, Italy, Spain, Germany, Australia, Aotearoa New Zealand, or France) and enter the Country Contest for that country;
  • Are at least eighteen (18) years old, or the age of majority in their jurisdiction of residence, whichever is greater, as of the date of entry; and
  • Otherwise satisfy these Master Terms and the applicable Country-Specific Terms.

Employees, contractors, and directors of CrossFit, LLC and its parent, subsidiary, and affiliated companies, and each of their immediate family members (spouse, parent, child, or sibling, and each of their spouses) and members of the same household (whether related or not), are not eligible to participate. The Contest is void where prohibited or restricted by law. CrossFit reserves the right to restrict eligibility where required by applicable law, including applicable trade sanctions or export controls.

  1. CONTEST PERIOD

The entry period begins on Friday, August 28, 2026, at 12:00 AM Pacific Time and ends on Wednesday, September 30, 2026, at 5:00 PM Pacific Time (the “Entry Period”). Submissions received before or after the Entry Period will not be considered. CrossFit reserves the right to extend, shorten, or otherwise modify the Entry Period in its sole discretion, subject to applicable law and the applicable Country-Specific Terms.

  1. HOW TO ENTER

To enter, during the Entry Period, an entrant (“Entrant”) must:

  • Complete the official submission form at https://forms.gle/jc1C5YLFSsUELfti9 (the “Entry Form”);
  • Use the submission section provided through the Entry Form to upload a video Submission that complies with Section 6 below;
  • Provide Entrant’s full name, email address, country of residence, and any other information requested on the Entry Form;
  • Accept these Master Terms and the applicable Country-Specific Terms; and
  • Accept the Content Release and License Agreement attached as Exhibit A as a condition of entry.

Entrants may submit multiple entries, provided that each entry is a separate and distinct video Submission and otherwise complies with these Terms. Each entry will be judged separately. The use of multiple identities or email addresses to circumvent any eligibility requirements or other restrictions may result in disqualification. No purchase or payment of any kind is necessary to enter or win.

  1. SUBMISSION REQUIREMENTS

Each video Submission must:

  • Be between 60 seconds (minimum) and 3 minutes (maximum) in length;
  • Be submitted in MP4, MOV, or another format specified through the Entry Form;
  • Highlight a compelling CrossFit story from the Entrant’s applicable market and demonstrate the Entrant’s storytelling ability;
  • Be submitted in the language of the Entrant’s choice. There is no requirement to submit in any particular national or local language. If the language used is something other than English, entrant must include English subtitles; and
  • Not contain material that is unlawful, obscene, defamatory, harassing, discriminatory, or that infringes the rights of any third party.

CrossFit reserves the right to reject, disqualify, or decline to consider any Submission that does not comply with these Terms, in its sole discretion, and to remove any Submission from consideration, from any archive, or from any platform at any time, subject to applicable law.

  1. ENTRANT REPRESENTATIONS, WARRANTIES, AND THIRD-PARTY PERMISSIONS

Obtaining all rights, releases, licenses, and permissions necessary for Entrant to submit a Submission, and for CrossFit to use it as described in these Terms, is solely Entrant’s responsibility. CrossFit is under no obligation to obtain or verify any such rights, releases, licenses, or permissions on Entrant’s behalf. By submitting an entry, Entrant represents and warrants that:

  • The Submission is Entrant’s own original work, or Entrant otherwise owns or controls all rights necessary to submit the Submission and to grant the license described in Section 8 below;
  • If the Submission depicts any other identifiable individual, Entrant has obtained a signed release from each such individual (or, if that individual is a minor, from their parent or legal guardian) authorizing Entrant to feature them in the Submission and authorizing CrossFit’s use of the Submission as described in these Terms;
  • If the Submission was filmed at a CrossFit affiliate gym or any other third-party location, Entrant has obtained permission from the affiliate owner or other applicable property owner to film at that location and to use the resulting footage as contemplated by these Terms;
  • If the Submission incorporates any music, sound recording, or other third-party copyrighted material, Entrant has obtained and can provide documentation for all licenses, clearances, and permissions necessary to permit CrossFit’s use of the Submission as described in these Terms; and
  • The Submission does not and will not infringe, violate, or misappropriate the intellectual property, publicity, privacy, or other rights of any third party.

Entrant agrees to indemnify, defend, and hold harmless CrossFit and its officers, directors, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to any breach of the foregoing representations and warranties, to the extent permitted by applicable law. CrossFit reserves the right to request copies of any releases, licenses, or permissions referenced above at any time and to disqualify any Submission for which such documentation is not promptly provided upon request.

  1. CONTENT RELEASE AND LICENSE GRANT

Regardless of whether an Entrant is selected as a winner, by submitting an entry, Entrant grants CrossFit a worldwide, perpetual, irrevocable, non-exclusive, transferable, sublicensable, and royalty-free license to use, reproduce, edit, adapt, translate, publish, distribute, publicly perform, publicly display, and create derivative works from the Submission, including Entrant’s name, voice, image, likeness, and biographical information contained in or accompanying the Submission, in any media now known or later developed, worldwide, in perpetuity, for any purpose, including marketing, promotional, editorial, and archival purposes, without further notice, compensation, or consent, except where prohibited by applicable law and subject to the applicable Country-Specific Terms.

As a condition of entry, Entrant agrees to execute CrossFit’s Content Release and License Agreement, attached as Exhibit A. Entrant’s acceptance of these Terms and submission of a Submission constitutes Entrant’s electronic execution of Exhibit A. CrossFit may separately request a countersigned copy from any Entrant and reserves the right to disqualify an entry, or decline to award a Prize, if a requested signed copy is not provided, subject to applicable law.

  1. SOCIAL MEDIA PERMISSIONS

Entrant grants CrossFit permission to feature, share, and repost the Submission and related content, including Entrant’s name and, where provided, social media handle, on CrossFit’s website and social media channels, consistent with the license granted in Section 8. Entrant is solely responsible for ensuring that Entrant’s own posting or hosting of the Submission complies with the terms of service of any platform used. CrossFit may credit or tag Entrant where practicable but is under no obligation to do so.

  1. JUDGING AND PRIZES

One (1) winner will be selected from each Country Contest, for a total of seven (7) Phase 1 winners. Subject to the applicable Country-Specific Terms, each winner will receive five thousand U.S. dollars (US $5,000) in cash, for a total Phase 1 prize purse of US $35,000 (each, a “Prize”).

Submissions will be evaluated by a judging committee that may include CrossFit HQ media leads, regional affiliate team members, and country representatives. Each Country Contest will be judged separately. CrossFit will consider the following criteria:

  • Story: Is this a compelling, meaningful CrossFit story?
  • Storytelling: Does the creator demonstrate an ability to make the audience care about the story?
  • Authenticity and Cultural Relevance: Does the Submission feel genuinely rooted in the local community and market?
  • Future Potential: Does the creator demonstrate potential to contribute to future CrossFit storytelling or content?

All judging decisions are final and not subject to appeal, except to the extent applicable law provides otherwise. The approximate retail value of each Prize is US $5,000. Prizes are not transferable. CrossFit may substitute a prize of comparable or greater value only where permitted by applicable law and the applicable Country-Specific Terms.

  1. WINNER NOTIFICATION AND CONDITIONS

Potential winners will be notified using the contact information provided on their Entry Form on or about the week of December 7, 2026. As a condition of receiving a Prize, each potential winner must, within the time specified in the notification, provide any eligibility, liability, publicity, tax, or other documentation reasonably required by CrossFit and, to the extent not already accepted under Section 8, execute Exhibit A, subject to applicable law. If a potential winner cannot be reached, does not respond, or does not timely provide required documents, CrossFit may disqualify that potential winner and select an alternate winner, subject to applicable law. Winners are expected to be announced publicly on or about the week of December 7, 2026.

  1. TAXES

Winners are solely responsible for any taxes associated with receipt or use of a Prize to the extent imposed on the winner by applicable law. CrossFit reserves the right to withhold from any Prize any amount required by applicable law and to request tax documentation reasonably necessary to comply with applicable law.

  1. GENERAL CONDITIONS

CrossFit reserves the right to modify, suspend, or terminate a Country Contest, or to disqualify any Entrant or Submission, if fraud, technical failure, misrepresentation, or any other factor impairs the integrity or fair administration of the Contest, as determined by CrossFit in its sole discretion and subject to applicable law. CrossFit is not responsible for lost, late, incomplete, misdirected, or garbled entries, or for technical, hardware, software, platform, or network failures of any kind.

  1. RELEASE AND LIMITATION OF LIABILITY

By participating, Entrants release CrossFit, LLC and its affiliates, officers, directors, employees, and representatives from liability related to: (a) claims arising from entry into or participation in the Contest; (b) the use, misuse, or results of using any Prize; and (c) technical errors, lost entries, or unauthorized interference with the entry process, in each case to the maximum extent permitted by applicable law. To the maximum extent permitted by applicable law, CrossFit will not be liable for indirect, incidental, or consequential damages arising out of the Contest.

  1. PRIVACY AND COMMUNICATIONS

Information collected in connection with the Contest will be used in accordance with CrossFit, LLC’s Privacy Policy, available at https://privacy.crossfit.com/, the applicable Country-Specific Terms, any supplemental privacy notice presented with the Entry Form, and applicable data protection law. Where required by applicable law, CrossFit will provide additional disclosures and obtain any consent separately from acceptance of these Terms, including with respect to special categories of personal data or transfers of personal data to another country. Entrants may separately opt in to receive marketing communications from CrossFit. Any marketing opt-in is optional and will not affect eligibility or judging. Entrants may opt out of marketing communications at any time using the unsubscribe instructions provided in those communications.

  1. PUBLICITY

Except where prohibited by law, and in addition to the license granted under Section 8, acceptance of a Prize constitutes a winner’s consent to CrossFit’s use of their name, likeness, and statements about their experience for advertising and promotional purposes without further compensation, subject to the applicable Country-Specific Terms.

  1. NOT ENDORSED BY SOCIAL NETWORKS OR SUBMISSION PLATFORM

The Contest is not sponsored, endorsed, administered by, or associated with Instagram, TikTok, YouTube, Facebook, X, Iconik, or any other social network or third-party platform used in connection with the Contest.

  1. GOVERNING LAW AND DISPUTE RESOLUTION

Except where prohibited or limited by applicable local law, these Terms and disputes arising from the Contest will be governed by the laws of the State of California, without regard to conflict-of-laws principles, and claims will be resolved through binding arbitration in California under the rules of the American Arbitration Association. Nothing in this Section deprives an Entrant of any mandatory consumer protection, choice-of-law, jurisdiction, or other right that cannot be waived under the law applicable to that Entrant. Any arbitration requirement applies only to the extent enforceable under applicable law and the applicable Country-Specific Terms.

  1. COUNTRY-SPECIFIC TERMS

The following Country-Specific Terms are incorporated into and form part of these Master Terms: Exhibit B (South Korea), Exhibit C (Italy), Exhibit D (Spain), Exhibit E (Germany), Exhibit F (Australia), Exhibit G (Aotearoa New Zealand), and Exhibit H (France). Entrants should review the exhibit applicable to their Country Contest before submitting an entry.

EXHIBIT A
VIDEO CONTENT RELEASE AND LICENSE AGREEMENT

This Video Content Release and License Agreement (this “Agreement”) is entered into by and between CrossFit, LLC (“CrossFit”) and the undersigned entrant (“Entrant”) in connection with Entrant’s submission (the “Submission”) to the CrossFit Stories Video Contest – Phase 1 (the “Contest”). Entrant’s acceptance of the Contest’s Master Terms, the applicable Country-Specific Terms, and submission of an entry constitutes Entrant’s electronic execution of this Agreement; CrossFit may also request Entrant’s signature below.

  1. Grant of Rights.

Entrant grants CrossFit a worldwide, perpetual, irrevocable, non-exclusive, transferable, sublicensable, royalty-free license to use, reproduce, edit, adapt, translate, publish, distribute, publicly perform, publicly display, and create derivative works from the Submission, and from Entrant’s name, voice, image, likeness, and biographical information contained in or accompanying the Submission, in any and all media, whether now known or later developed, for any purpose, including marketing, advertising, promotional, editorial, and archival purposes, subject to applicable law and the applicable Country-Specific Terms. This grant applies regardless of whether Entrant is selected as a Contest winner.

  1. Entrant Representations and Warranties.

Entrant represents and warrants that: (a) Entrant is the sole author and owner of the Submission, or otherwise controls all rights necessary to grant the rights above; (b) Entrant has obtained all model releases, location/gym permissions, music licenses, and other third-party consents necessary for CrossFit’s use of the Submission as described herein, as further detailed in Section 7 of the Master Terms, which is incorporated into this Agreement by reference; and (c) the Submission does not infringe or violate any third party’s rights.

  1. Indemnification.

Entrant agrees to indemnify, defend, and hold harmless CrossFit from and against any third-party claims arising out of a breach of the representations and warranties in Section 2 above, to the extent permitted by applicable law.

  1. No Obligation to Use.

CrossFit is under no obligation to use the Submission in any manner and may decline to do so for any reason, subject to applicable law.

  1. Compensation.

Entrant acknowledges that, other than any Prize CrossFit may award under the Contest Terms, Entrant will receive no additional compensation for the rights granted under this Agreement.

  1. Governing Law.

This Agreement is governed by Section 18 of the Master Terms and the applicable Country-Specific Terms, subject to any non-waivable rights under applicable local law.

EXHIBIT B
SOUTH KOREA COUNTRY-SPECIFIC TERMS

These South Korea Country-Specific Terms apply only to the South Korea Country Contest and supplement the Master Terms. Capitalized terms not defined here have the meanings given in the Master Terms.

  1. Eligibility.

The South Korea Country Contest is open only to legal residents of the Republic of Korea who are at least nineteen (19) years old as of the date of entry. The age requirement reflects the age of majority under Article 4 of the Korean Civil Act.

  1. Korean-Language Terms.

A Korean-language version of the Master Terms, these South Korea Country-Specific Terms, and any material entry instructions should be made available to Korean Entrants. If there is an inconsistency between the English and Korean versions, the Korean version will control to the extent required by mandatory Korean law.

  1. Personal Information and Overseas Transfers.

Personal information relating to Korean Entrants will be processed in accordance with CrossFit’s Privacy Policy and applicable law, including the Korean Personal Information Protection Act (“PIPA”). To the extent required by PIPA, CrossFit will provide any legally required disclosures regarding the collection, use, processing, retention, or international transfer of personal information and will obtain any consent required by applicable law or rely on another lawful basis for such processing or transfer. Nothing in these Terms requires CrossFit to provide notices, disclosures, or obtain consents beyond those required by applicable law.

  1. Sensitive or Health-Related Stories.

Entrants are not required to disclose medical diagnoses, treatment information, or other sensitive personal information in order to enter. If CrossFit requests or processes information that requires separate consent under Korean law, any such consent will be obtained separately from acceptance of these Terms.

  1. Prize and Taxes.

The South Korea winner will receive a Prize with a stated value of US $5,000, subject to any withholding, reporting, currency-conversion, or payment requirements imposed by applicable law. CrossFit may request information reasonably necessary to administer the Prize and comply with applicable tax or payment obligations.

  1. Mandatory Korean Law.

Sections 14 and 18 of the Master Terms apply only to the extent permitted by Korean law. Nothing in the Master Terms or these South Korea Country-Specific Terms limits any statutory right or remedy that cannot lawfully be waived by a Korean Entrant.

EXHIBIT C
ITALY COUNTRY-SPECIFIC TERMS

These Italy Country-Specific Terms apply only to the Italy Country Contest and supplement the Master Terms. Capitalized terms not defined here have the meanings given in the Master Terms.

  1. Nature of the Italy Country Contest.

The Italy Country Contest is a skill-based call for the creation and submission of original audiovisual/storytelling works. The winner is selected solely on the merit of the submitted work using the judging criteria stated in Section 10 of the Master Terms. No element of chance is used to determine the winner.

  1. Intended Article 6 Exclusion.

The Italy Country Contest is intended to fall within the exclusion in Article 6(1)(a) of Italian Presidential Decree No. 430 of October 26, 2001 (D.P.R. 430/2001) for contests conducted exclusively for the production of literary, artistic, or scientific works where the award constitutes compensation for the work, recognition of personal merit, or encouragement in the public interest. For the Italy Country Contest, the US $5,000 award is intended as compensation and recognition for the selected creator’s artistic work and personal merit.

If, before launch or award, CrossFit determines based on advice of Italian counsel or a competent authority that the Article 6 exclusion is unavailable or that additional local formalities are required, CrossFit may modify the timing, administration, or award mechanics of the Italy Country Contest only to the extent reasonably necessary to comply with Italian law.

  1. Italian-Language Terms.

An Italian-language version of the Master Terms, these Italy Country-Specific Terms, and material entry instructions should be made available before entry. If there is an inconsistency between the English and Italian versions, the Italian version will control to the extent required by mandatory Italian law.

  1. Privacy; Health and Other Special-Category Data.

Personal data relating to Italian Entrants will be processed in accordance with Regulation (EU) 2016/679 (“GDPR”), applicable Italian data-protection law, CrossFit’s Privacy Policy, and any supplemental privacy notice presented with the Entry Form. Entrants are not required to disclose health information or other special-category data to enter. If a Submission voluntarily includes health information or other special-category personal data and CrossFit relies on explicit consent to process that information, the Entry Form will request that consent separately from acceptance of these Terms.

  1. Prize and Taxes.

The Italy winner will receive the award described above, subject to applicable Italian tax, reporting, withholding, and payment requirements. CrossFit may request information reasonably necessary to administer the award and comply with applicable law.

  1. Mandatory Italian and EU Rights.

Sections 14 and 18 of the Master Terms apply only to the extent permitted by mandatory Italian and European Union law. A choice of California law or arbitration provision will not deprive an Italian consumer of protections that cannot be waived under applicable Italian or EU law.

EXHIBIT D
SPAIN COUNTRY-SPECIFIC TERMS

These Spain Country-Specific Terms apply only to the Spain Country Contest and supplement the Master Terms. Capitalized terms not defined here have the meanings given in the Master Terms.

  1. Free Skill Contest.

The Spain Country Contest is free to enter and is determined solely by the judging criteria in Section 10 of the Master Terms. No purchase or payment is required and no element of chance determines the winner.

  1. Clear and Accessible Contest Conditions.

The Sponsor will make the Master Terms, these Spain Country-Specific Terms, and the material conditions of access and participation readily accessible to Spanish Entrants before they submit an entry. The Contest and Sponsor will be clearly identified in contest communications. This provision is intended to reflect the transparency requirements applicable to electronic promotional contests under Article 20 of Spanish Law 34/2002 on Information Society Services and Electronic Commerce.

  1. Spanish-Language Terms.

A Spanish-language version of the Master Terms, these Spain Country-Specific Terms, and material entry instructions should be made available before entry. If there is an inconsistency between the English and Spanish versions, the Spanish version will control to the extent required by mandatory Spanish law.

  1. Privacy; Health and Other Special-Category Data.

Personal data relating to Spanish Entrants will be processed in accordance with the GDPR, applicable Spanish data-protection law, CrossFit’s Privacy Policy, and any supplemental privacy notice presented with the Entry Form. Entrants are not required to disclose health information or other special-category data to enter. If a Submission voluntarily includes health information or other special-category personal data and CrossFit relies on explicit consent to process that information, the Entry Form will request that consent separately from acceptance of these Terms.

  1. Prize and Taxes.

The Spain winner will receive a Prize with a stated value of US $5,000, subject to applicable Spanish tax, reporting, withholding, currency-conversion, and payment requirements. CrossFit may request information reasonably necessary to administer the Prize and comply with applicable law.

  1. Mandatory Spanish and EU Rights.

Sections 14 and 18 of the Master Terms apply only to the extent permitted by mandatory Spanish and European Union law. A choice of California law or arbitration provision will not deprive a Spanish consumer of protections that cannot be waived under applicable Spanish or EU law.

 

EXHIBIT E
GERMANY COUNTRY-SPECIFIC TERMS

These Germany Country-Specific Terms apply only to the Germany Country Contest and supplement the Master Terms. Capitalized terms not defined here have the meanings given in the Master Terms.

  1. Free Skill Contest.

The Germany Country Contest is free to enter and is determined solely by the judging criteria in Section 10 of the Master Terms. No purchase or payment is required and no element of chance determines the winner.

  1. Transparency of Material Terms.

The Sponsor will make the material participation conditions, eligibility requirements, judging criteria, Prize information, Entry Period, and these Terms available to German Entrants in a clear and timely manner before entry. Nothing material to an Entrant’s decision to participate will intentionally be withheld or presented in an unclear, unintelligible, or ambiguous manner. This provision is intended to reflect, among other requirements, the transparency principles in Section 5a of the German Act Against Unfair Competition (UWG).

  1. German-Language Terms.

A German-language version of the Master Terms, these Germany Country-Specific Terms, and material entry instructions should be made available before entry. If there is an inconsistency between the English and German versions, the German version will control to the extent required by mandatory German law.

  1. Privacy; Health and Other Special-Category Data.

Personal data relating to German Entrants will be processed in accordance with the GDPR, applicable German data-protection law, CrossFit’s Privacy Policy, and any supplemental privacy notice presented with the Entry Form. Entrants are not required to disclose health information or other special-category data to enter. If a Submission voluntarily includes health information or other special-category personal data and CrossFit relies on explicit consent to process that information, the Entry Form will request that consent separately from acceptance of these Terms.

  1. Prize and Taxes.

The Germany winner will receive a Prize with a stated value of US $5,000, subject to applicable German tax, reporting, withholding, currency-conversion, and payment requirements. CrossFit may request information reasonably necessary to administer the Prize and comply with applicable law.

  1. Mandatory German and EU Rights.

Sections 14 and 18 of the Master Terms apply only to the extent permitted by mandatory German and European Union law. A choice of California law or arbitration provision will not deprive a German consumer of protections that cannot be waived under applicable German or EU law.

 

EXHIBIT F
AUSTRALIA COUNTRY-SPECIFIC TERMS

These Australia Country-Specific Terms apply only to the Australia Country Contest and supplement the Master Terms. Capitalized terms not defined here have the meanings given in the Master Terms.

  1. Free Skill Contest.

The Australia Country Contest is a genuine game of skill. Entry is free, and the winner will be determined solely by the judging criteria in Section 10 of the Master Terms. No random draw or other element of chance will be used to determine the winner.

  1. Australian Consumer Law.

The Sponsor will conduct and advertise the Australia Country Contest in a manner consistent with the Australian Consumer Law, including by clearly and accurately stating the material conditions of entry, judging process, Prize, and winner-selection process. Nothing in the Master Terms or these Australia Country-Specific Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot lawfully be excluded under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law.

  1. Privacy.

Personal information relating to Australian Entrants will be handled in accordance with applicable Australian privacy law, CrossFit’s Privacy Policy, and any collection notice presented with the Entry Form. Any marketing consent will be optional and separate from entry. Entrants are not required to disclose health information or other sensitive information to enter. If CrossFit requests sensitive information for a purpose requiring consent under applicable Australian law, any required consent will be obtained separately.

  1. Content and Moral Rights.

To the extent permitted by applicable law, Entrant consents to CrossFit and its licensees exercising the rights granted under Section 8 of the Master Terms and Exhibit A, including editing, adapting, cropping, translating, combining, or otherwise modifying the Submission. To the extent any act would otherwise infringe an Entrant’s moral rights under Australian copyright law, Entrant gives any consent reasonably necessary to permit the uses expressly authorized by the Contest Terms, to the extent such consent may lawfully be given.

  1. Prize and Taxes.

The Australia winner will receive a Prize with a stated value of US $5,000, subject to applicable Australian tax, reporting, withholding, currency-conversion, and payment requirements. CrossFit may request information reasonably necessary to administer the Prize and comply with applicable law.

  1. Mandatory Australian Law.

Sections 14 and 18 of the Master Terms apply only to the extent permitted by applicable Australian law. Nothing in the Contest Terms limits any statutory right or remedy that cannot lawfully be waived by an Australian Entrant.

 

EXHIBIT G

AOTEAROA NEW ZEALAND COUNTRY-SPECIFIC TERMS

These

Aotearoa New Zealand Country-Specific Terms apply only to the

Aotearoa New Zealand Country Contest and supplement the Master Terms. Capitalized terms not defined here have the meanings given in the Master Terms.

  1. Free Skill Contest.

The Aotearoa New Zealand Country Contest is a genuine game of skill. Entry is free, and the winner will be determined solely by the judging criteria in Section 10 of the Master Terms. No random draw or other element of chance will be used to determine the winner.

  1. Fair Trading and Consumer Rights.

The Sponsor will clearly and accurately state the material conditions of the Aotearoa New Zealand Country Contest, including applicable time limits, the Prize, and how the winner will be selected. The Sponsor will not make misleading or deceptive representations regarding the Contest or Prize. Nothing in the Master Terms or these Aotearoa New Zealand Country-Specific Terms excludes, restricts, or modifies any right or remedy that cannot lawfully be excluded under the Fair Trading Act 1986 or Consumer Guarantees Act 1993.

  1. Privacy.

Personal information relating to Aotearoa New Zealand Entrants will be handled in accordance with the Privacy Act 2020, CrossFit’s Privacy Policy, and any collection notice presented with the Entry Form. Entrants will be informed of the purposes for which their personal information is collected and used and of applicable rights to access and request correction of their personal information. Any marketing consent will be optional and separate from entry.

  1. Electronic Marketing.

Participation in the Contest does not constitute consent to receive commercial electronic messages. If CrossFit seeks consent to send marketing communications, such consent will be obtained separately and any such communications will be sent in accordance with the Unsolicited Electronic Messages Act 2007, including applicable identification and unsubscribe requirements.

  1. Prize and Taxes.

The Aotearoa New Zealand winner will receive a Prize with a stated value of US $5,000, subject to applicable Aotearoa New Zealand tax, reporting, withholding, currency-conversion, and payment requirements. CrossFit may request information reasonably necessary to administer the Prize and comply with applicable law.

EXHIBIT H
FRANCE COUNTRY-SPECIFIC TERMS

These France Country-Specific Terms apply only to the France Country Contest and supplement the Master Terms. Capitalized terms not defined here have the meanings given in the Master Terms.

  1. Free Skill Contest.

The France Country Contest is free to enter and is determined solely by the judging criteria in Section 10 of the Master Terms. No purchase or payment is required and no element of chance determines the winner.

  1. French-Language Terms.

A French-language version of the Master Terms, these France Country-Specific Terms, and material entry instructions should be made available before entry. If there is an inconsistency between the English and French versions, the French version will control to the extent required by mandatory French law.

  1. Privacy and Contest Administration.

Personal data relating to French Entrants will be processed in accordance with Regulation (EU) 2016/679 (GDPR), applicable French data-protection law, CrossFit’s Privacy Policy, and any supplemental privacy notice presented with the Entry Form. Personal information collected for Contest administration and Prize fulfillment will not, solely by reason of participation, be used for electronic marketing.

  1. Marketing Consent.

Participation in the Contest is not conditioned on consent to receive marketing communications. If CrossFit seeks consent for electronic marketing, the consent request will be presented separately from acceptance of the Contest Terms, will require a clear affirmative action, and will not use a pre-checked box. Refusing or withdrawing marketing consent will not affect an Entrant’s eligibility or judging.

  1. Health and Other Special-Category Data.

Entrants are not required to disclose health information or other special-category personal data to enter. If a Submission voluntarily includes health information or other special-category personal data and CrossFit relies on explicit consent to process that information, the Entry Form will request that consent separately from acceptance of these Terms.

  1. Prize and Taxes.

The France winner will receive a Prize with a stated value of US $5,000, subject to applicable French tax, reporting, withholding, currency-conversion, and payment requirements. CrossFit may request information reasonably necessary to administer the Prize and comply with applicable law.

  1. Mandatory French and EU Rights.

Sections 14 and 18 of the Master Terms apply only to the extent permitted by mandatory French and European Union law. A choice of California law or arbitration provision will not deprive a French Entrant of protections, jurisdictional rights, or remedies that cannot be waived under applicable French or EU law.
