Somebody explain this video to me? How is this not copyright infringement? Daniel is a Box owner. How has MHP gotten away with this?
Why was the video posted, what about the journal article on not using "x-fit"...? This kind of stuff completely blurs what CrossFit/we are trying to clearly define. A unique, effective, comprehensive method of training the mind and body. I used to be a "there's nothing new in fitness" collegiate strength coach, I had to open a gym and start building a community to understand fully. It really bugs me that this video is pinned.. I hope it is meant to instigate a riot... just my 2

The Daniel Tyminski clip has to be satire, surely? That voice over was too much, sounded like something from an infomercial.
Russell Berger blocked my ability to respond to his FB response to me so I am posting it here and hope that freedom of speech applies here: Scott Hunter Russell Berger - yes, from my perspective, it is. Especially posting on crossfit.com. As someone who looks to you guys for guidance it is both disappointing and surprising that you chose to use a public forum to address an issue such as this. Instead of making MHP look bad it instead looks like you're taking a shot at one of your own. The sheer size of your audience and the power to influence you guys now have should can be as destructive as it is constructive. I have a feeling that many others share my opinion that this was done in poor taste and should be taken down from the crossfit.com. We all know that you have a right to protect your intellectual property, there is no need to insight a public stoning.

At the end of the day, by posting the video, we have probably increased this youtube hits x10 and given great exposure to MHP... forget the public stoning, that is in order, a box owner should know better! Virtuosity is branding is as important as virtuosity in squatting!!!

In fairness to Dan... Well that's it. I don't know him, but he sure seemed uncomfortable in the video, which suggests to me his conscience was eating away at him. Either way he put on the X-Fit shirt, c'mon guys, really??

I was the author of the article on trying to rise above "X-Fit" and the like. That does NOT mean, however, that intentional uses of variations of CrossFit's trademark that try to create consumer confusion will be ignored, especially not when they're in our trademark class or one so closely related.
I had hoped to work things out with the supplement guys at MHP amicably, but alas, it's not to be. I had conversations with some of their senior folks and lawyers, but... well, you see it.

I think using the "X-Fit" is distasteful if not illegal. However, just because CrossFit has made serious cross training successful to a lot of people doesn't mean others aren't allowed to exercise in the same way. Many have for a long time before CrossFit and will in the future.
The genius behind CrossFit is the community. I love working out with a team towards the same end, being better, healthier.
I agree with Hunter. Seems like we're taking a step down to publicly beat down this video on the main site. I say this as one who is annoyed at the infringement, too. It's the wrong venue and feels like a common YouTube troll fight.
One of our own? Sorry but the minute this dude started working this project he abandoned Crossfit and the rest of us. He brought this upon himself. Anyone who has ever worked one of these deals and has been on a set knows this just doesn't happen by mistake. Its not like he can say it happened so fast I got caught up in the moment and next thing I know I was in an infomercial selling supplements for a brand that ripped off the company that has given me more capitalist freedom than any brand this side of Hong Kong.
Much is expected from those who much is given. Glassman is constantly offered deals and urged to sell out, but he doesn't because he believes in it, and he has given all of us more than any one of us could fathum. I think it appropriate for the rest of us to stay true to the ethos figuring he hasn't sold out and left the brand to be butchered and ruined by weird money hungry parasites who would see it destroyed as long as they turn a profit for a little while.
No this dude worked on this deal, shot and re-shot the infomercial negotiated, etc. etc.
He knew what Crossfit is and wants to remain and he knew this other thing is not and never will be what we are, but he went forward anyway working directly against the objectives of the community. What a scrub.
And in case anyone missed it "Crossfit" flashed on the white board for a quick second. To me that dude is a sell out and a trader to us, and a rip off and thief when it comes to Glassman.
Oh and anyone who says well Crossfit doesn't own the dead lift all I can say is well ford doesn't own the wheel, but when they combine it with other common parts they don't exclusively own and/or invent to create one of THEIR vehicles, THAT vehicle is theirs.
The "X-Fit" video is definitely satire. HQ is warning what the future may hold if the Anthos deal goes through. No way this is real.

can remember having mixed feelings when the Games moved to LA and the home depot centre.
Yeah it was great that this amazing way to get people into the best shape and trying new things was being taken to the next level.
But also worried that we have would be hijacked by people and companies just wanting to use Crossfit as a way to make money, and do all the things we as gym goers had turned our back on as we realised its BS.
Well it seems that day has come to pass, with that crappy infomercial video using XFIT ( whatever the hell that is) to sell a product.
HQ please don't post 1 week about how you will clamp down on people using the brand when they are not allowed to do, then next week posting a video of a company doing exactly that.

While I am appalled that a games athlete would do this, and I am still not 100 percent sure this isn't a joke I feel a liitle bit like this only strengthens the real brand name -how many fashion designers or car manufacturers are there out there? You try to sell people on something cheaper or faster it dies quick. No one wants "MHP-xfit" . The instruction in the video was awful that narrative terrible what those guys were doing in that video was marketing we aren't into marketing we are into excellence remember? The videos that hq puts online are to highlight amazing people doing amazing things not trying to sell you something I won't lose one minute of my day worrying about stuff like this it's going to come and go.

Few things:
#1. Its disappointing that HQ would post a video trying to call into question someone who has shed blood, sweat and tears for this sport. The tactics are unfortunate.
#2. Dan is sponsored by MHP, just as Rich Froning is sponsored by BSN.
#3. Dan isn't trying to do anything with the name X-fit, its a line of their supplements.
#4. He's not trying to make his own sport, or take credit for anything, that would be MHP's tailoring of the video. Its not Dan doing anything for $, its MHP. He simply gets free supplements. Certainly nothing ill-intentioned.
#5. Dan represents CrossFit, owns a box himself, and has an impact on hundreds (and thousands of fans) in a positive way under the name of CrossFit. Everyone loves him, his coaching, and his approach to life in general.
I support Dan, what he does on a day-in-day-out basis (get up at 530am to make people's lives better through CrossFit, closing down for the day after 8pm), he's inspired hundreds and thousands of people, has a great following due to his performance at the 2012 Games (14th in the world), and will continue to do so even after the unfortunate posting trying to drag him down. The man is a role model, with great intentions and great character. Period.

For those of you who think this is satire, it is not. This is legit, some of you may remember Dana Lynn Bailey doing Linda under MHP's X-fit as well.
Dan's "X-Fit" doings have been addressed to him previously by HQ and he knew the water he was getting in to. While he may not have known that MHP would do this exactly, he knew he was walking on very thin ice.
In the end Dan is wrong, HQ did the best thing they could by posting this for us to see. I would not bash HQ for "publicly stoning one of their own athletes". We are doing the stoning, not HQ, they simply hung him out to dry and showed us all what he is doing, and that it is wrong.

This was a video designed to promote the sport of CrossFit...not a deliberate attempt to "Steal" anything from anyone. The language is incorrect. Everyone makes mistakes. The term "X-Fit" is the name of a SUPPLEMENT line...NOT the name of any fitness program. Those are completely 2 different things.
@ #32 - I'm pretty sure (insert your favorite author) didn't invent the words "the", "go", "mission", "for", etc, etc but somehow s/he was able to copyright a book full of these, and other such words into a certain order, known as sentences, that when combined, complete something known as "intellectual property".

Cross training is. x-fit is. It's manipulative and deliberate exploitation of the CrossFit brand. (I didn't see or hear "WOD, Diane, box etc)
You state the language is incorrect. What does that mean? It's a "deliberate" script researched and approved by some creative team that knew to avoid using actual CrossFit nomenclature. It's a deliberate attempt to sell product.
It may not be 'stealing' by your definition and it may not be legal stealing (I'm not a lawyer) but guess what? I am a judge. I'm a judge of ethics and integrity.
If I decide to open a "MacDonald's" burger joint, am I really promoting McDonalds? Really? You believe that?
IMO this is no different than the cross-gym issue and other companies that want to capitalize on the Crossfit brand.
I agree with Josh #52, but for the unsuspecting public, we need Dale & legal & public exposure to educate people because right now there are people in and outside the community thinking about ways to make $$ off of Crossfit, they're not really trying to contribute, they're not thinking about best-practices, they're thinking about money or margin. And exposing MHPs marketing practices will in fact dissuade many others from exploiting the brand.
I hope they're paying you a lot for those videos.

I did a different WOD early this morning:
For time: 50 L Pullups, 50 HSPU, 50 T2B, 50 jumping lunges - 14:44
Do the jumping lunges with a slight hold at the bottom and explode up and switch legs each rep.
Fun WOD... I wanted to change up the 100 pullups, 100 pushups, 100 situps, 100 squats WOD so I decided to make this one up. This would be the MARY to the above mentioned CINDY. All the movements are a bit more complex and a bit slower, but still great movements. I could have gone a little faster, but I was really concentrating on really nice clean movements. NO CHEATED MOVEMENTS... plus it was really early in the morning. I biked over to harmony playground area and then warmed up for about 15-20 minutes.
Then I did the WOD, stretched pretty quickly, and then biked home to walk the dog and get the kids ready for camp and me for work.

Tyminski-was that supposed to be an apology? The only way to fix this is to cut ties with a company that isn't original enough to come up with their own name or workouts. You have to step back and imagine it from the perspective of the community. No one is going to buy that supplement now either, and future deals for you are down the drain because of your choice to take an endorsement that offends the community. Seems to me your best choice is to turn around now, if it's not to late already. You are a good athlete with lots of years of competing left-don't wast it for a check and loss of respect.
Just wanted to mention Zack Height's excellent work on the wod demo vid. Solid form throughout, even on his heaviest lifts. Nice to see.

Intentionally employing a mark, name, or slogan that is confusing similar to another mark in a similar space is piracy.
The argument that this was done by MPH in good faith is meritless. The supplement company is promoting the sale of fitness related goods through the naming and marketing of goods and advertising that are by nature, name, and design confusingly similar to CrossFit. CrossFit did not invent DLs and HSPUs, and they are not claiming such ownership (the workout is in fact free for public consumption). What they are claiming is that companies like MPH who intentionally use similar tags like XFit are diluting the value and spirit of CrossFit's brand. A 100% legitimate concern. Prosecute, purge and pillage away HQ.
CrossFit has the right to (and for every affiliate owner's sake -- duty to) protect the brand.
I have been following CrossFit (the real deal) For a year now. I passed my CF-L1 in Dec. 2011... How things have changed since then. We are faced with a huge challenge to remain united as keepers of the only thing that really makes CrossFit different: its sense of community and its Virtuousity.
For those of you old enough to remenber "Comming to America" with Eddie Murphy; the McDowel's of CrossFit is MHP X-fit and there are certainly more to come.
It feels like Tyminski thinks of CrossFit only as a Sport and the method or ranks you fall into to train for the Sport of CrossFit can be anything...
He's wrong, but he's also right... Hypothetically, an athlete who does the open and the regionals could qualify for the games even if this person did not train with the CrossFit methods...
However Tyminski sold out and is trying to take credit for a "new form" of "Cross-Training" that is in fact CrossFit. The problem now is that new-comers will now have two entities to chose from, and most will be uneducated...

MHP is using the momentum of the crossfit movement to sell supplements. It is a quick money grab, something that the crossfit brand has stayed away from. Many are concerned the similar name ( X-FIT compared to Crossfit) will confuse noncrossfitters, and then they will think that Crossfit, not X-FIT, is selling supplements for a quick money grab. That would hurt the otherwise clean reputation the Crossfit Brand has.
I dont think most people have an issue with a company selling supplements to crossfitters (especially ones that are somewhat unique - unlike most, their preworkout is approved for competition). People however have a big issue with MHP knowing and willing selecting a name that will intentionally deceive people due to its similarity to Crossfit. MHP wants to deceive the uninformed into thinking there is an association between X-FIT and Crossfit when there isn't one. Doing Diane without actually calling it Diane in the video furthers this idea.
Promote and sell your product, just don't do it using naming gimmicks, especially when those gimmicks could hurt the crossfit brand.

There is not much to say here, except "cut the shiz." This is too many times that an individual is chastised. If you have a problem, mention it to MHP. Do not go after Dan. Who by the way, is actually a really good dude, and one of my close friends.
All the hate...why because he is out of the mold of what CrossFitters were? or have become? Why because he dresses differently? Why because he uses different supplements? Come on...do you guys all know that Dan donated his bike and a bunch of gear to CrossFit kids for auction? Did you know that Dan brought out 30 athletes to my Box PUMP last year, and in one day with 60 of our combined athletes raised over 10k in toys and gifts for kids who didn't have a Christmas waiting for them at home.
Before stones are thrown, look at yourself first. It's ok not to fit the mold. It's ok to have a different take. Do i support the way MHP handled the videos, NO i dont, and still dont...and guess what I am an MHP athlete as well. But that does not mean that Dan's name gets dragged. We are adults, it's about time that all of us start acting like them on this board.
Calling people names is not necessary. Just live a good life, and no need to be so angry. Take a breath and see what is great...we lift, we run, we jump, we do crazy stupid stuff because we love to...just remember why we all became a part of this community.

MHP is simply jumping on this CrossFit craze with their supplement line. Simple economics- big idea, supplemental goods. Arent we Americans infamous for this concept? Its marketing. Love it or hate it, MHP is making strides with their product with both negative and positive publicity. Don't hate the player, hate the game. Tyminski is STILL the man. Served his country, and living his American dream.
How about the demo video of the chipper workout the other day...the one where the entire left side of the gym was lined with racks of clothing and accessories for sale. I didn't hear anyone complaining then. Moreover, did the x-fit stop anyone from doing today's workout? Does it stop anyone from training at "high intensity"? No, it didnt.
Wow! This video is pretty embarrasing for Tyminski. MHP went exploited this kid to the extreme.
Not knowing the guy or anything about MHP, I thought this X-Fit/MHP was Tyminski's way to capitilize off of CrossFit by the way video was shot. "Athletes" and Affiliate owners need to be aware of the legal aspect of the CrossFit name and what they (Hq) has built. Just because you are an affiliate and a "popular" Elite Fitness Competitor doesn't give you any extra clout to try and capitalize on CrossFit. Some have posted "He might not have been involved with the video development: etc..He's wearing a X-Fit tee shirt- HE KNOWS HE IS RIPPING OFF CROSSFIT! Unless he is THAT dumb, which it seems he may actually be. Maybe and IQ test should be added to the Level 1 or affiliate agreement.

Boomsauce could have done much better by not blatantly using a "benchmark" Crossfit that he "designed exclusively for MHP X-Fit." If he were to have used 20-15-10 reps of HSPUs then Deadlifts stressing the "HSPUs will smoke your arms making the deadlifts much more difficult, blah, blah, blah...", then he might have had a legit video.
I agree that Crossfit did not invent DLs and HSPUs or that it does not hold a patent on the rep scheme of 21-15-9, but to pass off such a benchmark workout as your "own exclusive design" is downright plagarism. The posting of this video is my mind is an effort to let the CF community know what big business wants to do with our culture.

I feel like if you are going to do this, just own it, don't try to make it out to be a big "misunderstanding"
The more comments I am reading I'm starting to think more and more that people are looking at this from the wrong perspective, of course it would be great to live in a world where the only authority on fitness is Crossfit because it is far superior to anything else out there, but if people think that "X-FIT" from MHP is going to be the only thing that comes at us then I want to be drinking from the Half Full glass you are. Roughly 4,500 boxes world-wide lets put that in the perspective of WALMART or as bad as I hate to say it MCDONALDS in a global economy CrossFit is a minimal bleep on the radar, but guess what nothing is going to derail this train from getting longer. X-FIT might have Daniel Tyminski but they do not have Dave Castro, Tony Blauer, Chuck Carlsmann, Andy Hendel, athletes like Rob Orlando, or even the name and face of CrossFit Greg Glassman behind the steering wheel. Anyone that is worried about this insignifcant video needs to take about 10 more minutes and re-watch "THE PURSUIT OF EXCELLENCE" then go make yourself or someone else BETTER using CrossFit methodologies. get ready boys and girls this is only the beginning you all really think 20 million by anthos causes a stir wait till its more like 100 million by NIKE or 150 Million by CITIBANK. I think this is way overblown - X Fit is a supplement. Xtreme Fitness Intensity Training. Same kinda thing with P90X. In supplements, X does not mean Cross. It means Extreme. Not CrossFit. And there are a lot of X fit products out there, and x fit gyms, and other x-fit stuff. Not by MHP.
Have you tried the product X Fit Trainer? You might want to. I like it as a pre-workout.
I just got an email about some other company's product called WOD FUEL. Pretty clear they are trying to capitalize on the CrossFit name - it is all over their website. They even say WOD is CrossFit's acronym for Workout of the Day (WOD is also used by others as well). When you are popular, people want to associate to you. Doesn't mean they are necessarily stealing from you. It is flattery - even if you don't like it, it brings the importance of our crossfit community to a broader audience.
Don't love the video using Diane, but my guess is the MHP people don't know that it is Diane or what Diane is. This might all be on Boomsauce.

So I'm wondering, if I decide to sign up for a Tai-Quan-Do class, a National Boxing Association Boxing class and a Brazilian Jiu Jitsu class, get really good at them and start my own gym or make some instructional videos, do I need to make sure I call it "Tai-Quan-Do-Brazilian-Jiu-Jitsu-National-Boxing-Association-Boxing-Self-Defense"? Or can I just call it Dan's Self Defense For Idiot's?
I mean what if I don't want to pay the National Boxing Association or the United States National Taekwondo Federation or the National Brazilian Jiu Jitsu Federation a fee every time I make a buck teaching people how to defend themselves. Or every time I give them a certificate of completion from "Idiot Dan's Self Defense"
Maybe Crossfit HQ didn't want there name associated with that product and therefore did not give permission to use there name or references to there workouts. It doesn't mean that an individual can't go outside of the box to make a living for themselves. I'm sure the guy has paid his affiliate fee or he wouldn't be an affiliate.
The fact is Crossfit is a method, a theory. Yes it's an awesome one at that. And while I cannot as an individual give the Nike corporation the o.k. to use the term "Crossfit" in there advertising in order to sell more clothes, crossfit doesn't own cross training. Many of us have been doing that for some time now. Just like the National Boxing Association doesn't own the practice of boxing.
What happens when the next guy adapts crossfit with some other training methodology to find even greater results and calls it "Mixfit" will he owe Crossfit HQ a cut? Or if he calls his gym "Stupidfit"? If so, some of you mixed martial arts clubs/ self defense systems better start writing some checks. I'd be willing to bet you've all take a class or 2 along the way.
If I do recall there was a term used in the late 80's I think it was called Cross Training? Sounds allot like, oh never mind.

1st day ever doing cross fit workout--Prior to this, did typical split body part workouts combined with interval cardio 4 days a week. Typical workouts were for 1 hour (40 mins lifting/20 mins cardio).

360-Failed @ 365. No confidence. Went down way too slow & paused at bottom. Doomed to failure. Knee just starting to heal. Need to work on back squats.
165-Tried 170 on 3rd set. Not even close. 165 was a struggle. Barely got it. Was able to barely keep bar moving to keep from failing.
410!-Good job engaging IT band, lumbar. Came off the floor pretty easily. Thank goodness since back squat was so bad.
